TERMS OF USE

  1. WHO ARE WE?
    • The digital platforms and services (“Our Services”) are operated by Younus Community İletişim Bilişim ve Organizasyon Anonim Şirketi, a company registered in Türkiye, Istanbul, with registration number 9250979835 and its registered office located at Esentepe Mah. Talat Paşa Caddesi No:5 İç Kapı No:1 Şişli/Istanbul.
    • “YOU N US COMMUNITY” (“YOU N US” or “the Community”) refers to the exclusive, membership-based social community managed by Younus Community İletişim Bilişim ve Organizasyon Anonim Şirketi, which provides carefully curated experiences, events, and networking opportunities.
    • These Terms of Use, along with any additional terms referenced within (“Terms”), govern your access to and use of the websites (“Site”), mobile applications, and any services or content (“Our Services”) operated by YOU N US, including its affiliates, subsidiaries, and parent company (“we,” “us,” or “our” as applicable).
    • By accessing or using our Our Services and any related features or services, you confirm that you have read, understood, and agreed to be legally bound by these Terms. These Terms form a binding agreement between you and YOU N US.
    • If you do not accept these Terms, you must refrain from using our Our Services. Our services and Our Services are not intended for individuals under the age of 18. We advise parents and guardians to supervise their children’s online activities. By using our Our Services, you affirm that you are at least 18 years of age.

 

  1. MEMBERSHIP
    • Individuals wishing to apply for membership may do so only by referral from an existing Member and may attend one event free of charge under the “Friend of Us” category. Following their participation in such event, the applicant is required to complete the membership application form available on Y’s website, accurately and in full. The completed application form will be published in a members-only section of the website for a minimum of three (3) days and a maximum of seven (7) days. If any written objection is raised by an existing Member during this period, the application will be deemed rejected and will not be processed further. In the absence of any objection, the applicant shall be entitled to become a Member upon fulfillment of the payment obligations set forth in Clause 3 of this Agreement.
    • Membership eligibility is subject to an application process and approval by YOU N US, at its sole discretion. YOU N US reserves the right to request additional information or conduct background checks before granting membership. Membership, once approved, is valid for one (1) calendar year from the date of acceptance, and it is renewable annually, subject to continued compliance with these terms.
    • Membership provides Members with access to exclusive community events, networking opportunities, curated experiences, community communications, and selected benefits provided by third-party partners. The scope and nature of these benefits may vary and are subject to modification at the discretion of YOU N US.
    • Membership is strictly personal, non-transferable, and intended solely for the use of the approved Member. Sharing membership privileges, including but not limited to event invitations and communications, with non-members is strictly prohibited and may result in immediate termination of the membership without refund.
    • Members are expected to uphold the values of YOU N US, demonstrating respect, integrity, and community spirit at all times. Members agree to comply with the guidelines and codes of conduct as communicated by YOU N US.
    • Members may invite non-members as guests to selected events, subject to the specific terms and limitations set for each event by YOU N US. YOU N US reserves the right to limit the number of guests, require guest fees, or restrict guest access to certain experiences. Members are fully responsible for the conduct of their guests and any breach of this Agreement by a guest may be treated as a breach by the inviting Member.
    • Unless the Member provides written notice of non-renewal at least fifteen (15) days prior to the end of the membership term, membership will automatically renew for an additional one (1) year term at the prevailing membership rate. YOU N US will provide notice of upcoming renewal and applicable fees at least fifteen (15) days in advance of the renewal date. Members are responsible for ensuring their payment information is current to avoid any interruption of service.
    • Members are expected to maintain respectful, professional, and appropriate conduct at all YOU N US events, online interactions, and communications with other Members, guests, and organizers.
    • Any behavior that compromises the safety, enjoyment, integrity, or reputation of the Community — including but not limited to harassment, discrimination, excessive intoxication, or damage to property — may result in immediate termination of membership, and no refund shall be made in such termination.
    • YOU N US reserves the exclusive right to determine, in its sole discretion, what constitutes grounds for suspension or expulsion from the Community.
    • Members are fully responsible for the conduct of any guests they invite to events, and any misconduct by a guest may result in consequences for the inviting Member.

 

  1. FEES AND PAYMENT
    • Membership fees are payable annually in advance, upon acceptance into the Community or upon renewal. Failure to make timely payment may result in suspension or termination of membership.
    • All fees are non-refundable, except as explicitly stated in this Agreement.
    • YOU N US reserves the right to adjust membership fees upon renewal, provided that Members are given no less than fifteen (15) days’ prior written notice of any such changes.
    • Members are responsible for maintaining accurate and up-to-date payment information. YOU N US shall not be liable for any disruptions in membership benefits due to payment failures.

 

  1. CANCELLATION AND TERMINATION OF MEMBERSHIP
    • Members may cancel their membership at any time by providing written notice to YOU N US. Upon cancellation, no refund shall be made to the member.
    • YOU N US reserves the right to terminate the membership of any Member at its sole discretion, particularly in cases of conduct deemed harmful, disruptive, unlawful, or inconsistent with the values and purpose of the Community. In such cases of termination due to Member misconduct or breach of this Agreement, no refund shall be granted.
    • Upon termination or expiration of membership, access to community events, benefits, and communications will cease immediately.

 

  1. EVENTS AND DISCLAIMER
    • YOU N US organizes events at various third-party venues. While reasonable care is taken in selecting venues and partners, YOU N US does not assume responsibility for the condition, safety, or operations of third-party locations.
    • Attendance at events is entirely voluntary, and Members acknowledge that participation is at their own risk. YOU N US disclaims any liability for personal injury, property damage, or other losses sustained during such events.
    • YOU N US does not guarantee the frequency, availability, or specific content of events or experiences. Events are subject to change or cancellation without prior notice.
    • Certain events may have limited capacity or require additional fees. Members will be informed in advance of any such requirements.
    • Unless expressly stated otherwise, all costs related to transportation, accommodation, food and beverages, and other incidental expenses associated with events shall be solely borne by the Member. YOU N US shall not be held liable for such expenses and assumes no reimbursement obligation in this regard.
    • Members who wish to participate in events held abroad or in events that may pose a risk to life or property are required to obtain valid health insurance covering the duration of the event and to submit the relevant documentation to YOU N US. In the event that the Member fails to provide such proof within the designated time frame, Y reserves the right to deny the Member’s participation in the event and, additionally, to arrange the necessary insurance on behalf of the Member, with all associated costs to be borne by the Member.

 

  1. MEDIA RELEASE
    • By participating in YOU N US events, Members grant YOU N US permission to capture and use their image, likeness, and voice in photographs, videos, and other media for promotional and archival purposes.
    • Members who do not wish to be photographed or recorded must notify the event organizers in advance of the event.

 

  1. CHANGES TO THE TERMS
    • As our services and Our Services continue to develop, we may update these Terms from time to time. When changes are made, the updated Terms will be published on this page and will take immediate effect upon posting. By continuing to use the Our Services after any changes have been posted, you agree to be bound by the revised Terms. We recommend that you review these Terms periodically to stay informed of any updates.
    • To the fullest extent permitted by law, you are not permitted to link to, extract, or reuse any part of this Site or its Content for commercial purposes, nor may you use our trademarks in a way that implies endorsement or association with you or your business, or with any other entity, without our express prior written consent, which we may grant or deny at our sole discretion.

 

  1. ACCOUNT REGISTRATION AND SECURITY
    • While you may explore certain sections of the Site without creating an account, some features and services will require you to register. When choosing a username, you must avoid using the name of another individual with the intent to impersonate them, or any terms that are offensive, vulgar, or inappropriate. Your account details, including username and password, are personal and must not be shared with anyone else. You are fully responsible for maintaining the confidentiality of your account information and for all activities carried out through your account. Accounts are non-transferable and may not be sold or assigned. We are not responsible for any loss or damage arising from the unauthorized use of your account. Additionally, you must not attempt to access another user’s account without their explicit consent.
    • Should you become aware of any unauthorized use of your account or any other security concern, please notify us immediately in writing at younuscommunity@gmail.com. We reserve the right to require changes to your username and/or password if we suspect your account is at risk, or if we receive complaints regarding your username. Please note that you do not hold any proprietary rights over your account or username. Regardless of any terms set out in this agreement, we retain the right, at our sole discretion and without notice, to deny account creation, restrict access, suspend, or permanently deactivate any account. We may also modify or remove features, services, or content associated with accounts at any time, without incurring liability.

 

  1. USE OF CONTENT
    • Your access to and use of all materials on the Our Services, including but not limited to text, graphics, logos, images, photos, animations, applications, videos, audio, and any other multimedia content (“Content”), is subject to these Terms. Unless expressly authorized by us in writing, you may not copy, reproduce, transmit, adapt, modify, publish, distribute, or otherwise use any Content for purposes beyond your personal, non-commercial use. All Content is either owned by us or used under license from third parties.
    • To the maximum extent allowed by law, you are prohibited from linking to, extracting data from, or reusing any portion of the Our Services or Content for commercial gain, or using our trademarks in any way that suggests an endorsement or affiliation with you or your business, without obtaining our express prior written consent. Downloading or copying materials from our Our Services, even if permitted, does not transfer any ownership rights to you. All rights not expressly granted within these Terms are fully reserved by YOU N US.

  • The Our Services may occasionally link to third-party websites. These links are provided for convenience only. We do not control third-party websites and are not responsible for their content or operation. The inclusion of any links to third-party websites within the Our Services does not imply endorsement by us of the goods, services, or materials offered on such websites.
  • TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNLESS OTHERWISE STATED, WE SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE ARISING FROM YOUR USE OF THIRD-PARTY WEBSITES OR ANY PURCHASE MADE THROUGH THEM. YOU ACKNOWLEDGE THAT YOU ACCESS, USE, AND RELY ON THIRD-PARTY WEBSITES AT YOUR OWN RISK AND AGREE THAT WE SHALL NOT BE LIABLE FOR ANY LOSS, DAMAGE, OR HARM CAUSED BY SUCH USE.

 

  1. USE AND ACCEPTABLE CONDUCT
    • You must only use the Our Services for legal purposes in accordance with these Terms and are prohibited from using our Our Services to engage in any fraudulent activity or in a manner that (in our reasonable opinion) is liable to damage our business or harm other users. Your use of the Our Services is also subject to our membership rules and any other policies or guidelines that we may communicate to you from time to time.
    • You further agree that any personal data or other information you provide to us during registration or in connection with any services on the Our Services is accurate, complete, and up to date. You also warrant that you either own or have the necessary rights, licenses, permissions, or approvals to submit or post any materials on the Our Services.
    • Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable right to access and use the Our Services solely for your personal and non-commercial use. However, you agree not to:
      • Use the Our Services or any part thereof for commercial purposes or for the benefit of any other person or entity, including but not limited to selling, renting, leasing, assigning, transferring, hosting, or otherwise commercially exploiting any part of the Our Services;

      • Use software robots, spiders, scrapers, bots, crawlers, or similar data mining, gathering, or extraction tools, whether automated or manual, to access, acquire, analyze text, analyze data, copy, monitor, or make submissions through any portion of the Our Services;
      • Use the Our Services, Site, Content, or any related data (including associated metadata) for any machine learning or artificial intelligence purposes, including but not limited to training or developing AI technologies or machine learning language models;
      • Use the Site in any way that encourages, facilitates, or engages in criminal activity;
      • Intentionally or knowingly perform any action that may impose an unreasonable burden or load on the Our Services or its servers and infrastructure. Any unauthorized use of the Our Services or any portion thereof will immediately terminate the limited rights granted to you under these Terms, and such termination will be without prejudice to any other right or remedy we may have under applicable law or equity. You agree to indemnify and hold us harmless for any third-party legal actions or claims and any associated losses, damages, or expenses (including legal fees) arising from your breach of these obligations.

 

  • You further agree to comply with all applicable laws, rules, and regulations, and you will not:
    • Use the Our Services for any unlawful purpose;
    • Impersonate any person or entity, whether real or fictitious, including any employee or representative of our company;
    • Submit any content or information that is unlawful, fraudulent, defamatory, or otherwise objectionable, or infringes on our or any third party’s intellectual property rights or other rights;
    • Submit or provide links to any materials that could be considered harmful, obscene, pornographic, sexually explicit, indecent, lewd, violent, abusive, profane, insulting, threatening, harassing, hateful, or otherwise objectionable, including images or likenesses of individuals under 18 years of age or any personal contact information of third parties;
    • Submit or provide links to any materials that harass, degrade, victimize, or intimidate individuals or groups based on religion, race, ethnicity, sexual orientation, gender, age, or disability;
    • Harvest or collect information about other users of the Our Services.

 

  1. OUR LIABILITY
    • YOU N US shall not be held liable for any interruption, postponement, cancellation, or failure to meet expectations with respect to any event, content, or service provided within the scope of Membership.
    • YOU N US shall bear no responsibility for any direct, indirect, incidental, special, or consequential damages arising from the acts or omissions of third-party venue providers, service suppliers, or other participants.
    • Members acknowledge and agree that participation in events is entirely voluntary, and that all personal, physical, financial, and emotional risks associated with such participation are assumed solely by the Member.
    • YOU N US shall not be liable for any injury, illness, loss, damage, delay, disappointment, or any other harm incurred during or in connection with an event, whether directly or indirectly.
    • YOU N US makes no express or implied warranties regarding the accuracy, completeness, or currency of any content or information published on its website or provided during events.
    • In no event shall YOU N UStotal liability, whether in contract, tort, or otherwise, exceed the total annual membership fee paid by the Member.
    • Members expressly agree that this limitation of liability is fair, reasonable, and constitutes a fundamental term of this Agreement.

  1. INDEMNIFICATION
    • You agree to defend, indemnify, and hold us harmless from and against any claims, liabilities, losses, damages, costs, and expenses (including but not limited to reasonable attorneys’ fees) arising from or in connection with: (1) your access to or use of the Our Services or any part thereof; (2) your failure to comply with these Terms or any applicable law, regulation, or rule; (3) your infringement, misappropriation, or violation of the Our Services, Content, or any third-party intellectual property rights; or (4) any actions performed through your account, whether by you or any other individual using your account, with or without authorization. We will make reasonable efforts to notify you of any claim, action, or proceeding subject to the above provisions once we are aware of it, though failure to provide such notice will not limit your indemnification obligations unless you can prove that actual harm occurred as a result.
    • We retain the right, at your cost, to take exclusive control of the defense and settlement of any claim, action, or proceeding for which you are required to indemnify us. You agree to cooperate fully with us in defending such claims. You may not settle or resolve any claim, action, or proceeding for which indemnification is required without obtaining our prior written consent.

  1. TERMINATION

You may terminate these Terms at any time by discontinuing your access to and use of the Our Services and, if applicable, uninstalling them. However, if you decide to resume using the Our Services at any time, you will be subject to the current Terms. We may terminate these Terms, in whole or in part, at any time and without prior notice or liability for any reason. Upon termination, any provision that is meant to survive will remain in effect.

  1. PRIVACY & SECURITY

The collection, processing, and safeguarding of your personal data are governed by our Privacy Policy, which forms part of these Terms. Additionally, our Cookie Policy governs the use of cookies and other tracking technologies on the Our Services.

  1. INVALIDITY & WAIVER

If any provision of these Terms is deemed invalid or unenforceable by a court or regulatory authority, the remaining provisions will continue in full force and effect to the maximum extent permitted by law. A waiver of any provision of these Terms will be valid only if made in writing, and any failure to enforce a provision shall not be construed as a waiver of any future breach.

  1. FORCE MAJEURE

YOU N US will not be responsible and will not pay any compensation where we are preventing or delayed from performing our obligations due to an event beyond our reasonable control, including but not limited to flood, earthquake, mechanical breakdown, IT failure, fire, adverse weather conditions, acts of terrorism, gas, water or other utilities. In the event of a force majeure situation, Y shall promptly notify Members and shall be relieved from the performance of the affected obligations for the duration of such event.

  1. TRANSFER

We may transfer our rights and obligations under these terms to another organisation. In the event said transfer takes place, we will ensure that the transfer will not affect your rights under the contract.

  1. GOVERNING LAW AND DISPUTE RESOLUTION
    • For the interpretation of this Contract and/or the resolution of any disputes arising out of or in connection with this Contract, Turkish law shall directly apply without recourse to conflict of law rules, even if a foreign element is involved in the Contract.
    • In the implementation of this Contract, within the monetary limits determined annually in December by the Ministry of Trade of the Republic of Turkey, the Provincial or District Consumer Arbitration Committees located in the member’s place of residence or where the product was purchased shall have jurisdiction. For disputes exceeding this monetary threshold, the Consumer Courts shall have jurisdiction.
